Can Court Reverse / Cancel a Registration Title of an Immovable Property?
Briefly,
1. Lower court asked opposite party to appear in court as they owed us a lakh in legal fees over a disputed land deal that was ruled in our favour. (Property was also decreed to us but they got a stay order in high court after filing appeal which is still pending.)
2. Despite repeated summons (4-5 over a year) in lower court to pay us the us legal fees, opposite party didn't appear.
3. Judge got angry at them and ordered that disputed property be registered to us in lieu of the payment owed.
4. We paid 15+ lakhs as registration fees and registered the property with Tamil Nadu government registrar
5. We filed EP in court to give us possession of the land.
6. Now they are claiming that they had got a stay order from High court long back and so didn't appear in court, and the said registration shouldn't have been allowed.
7. They have now filed new appeal in High court to reverse / cancel the registration citing the older stay order.
We are at no fault here and followed the lower courts instructions - but can the High court still cancel / reverse / set aside our registered title and ownership of the land? If yes, under what law? If they do so, will we lose the registration fees we have paid?
