Eviction of trespassed private land.
Hello everyone,
Following are the Points of my matter to understand
1) My dad had done a registered contract of land lease for 3 years. One year after that, my dad passed away by massive heart attack. The land is being used for commercial purpose.
2) I am the legal owner of the property .Now the duration of 3 yrs registered contract is over. Though the Opposition party did not leave the possession of the land.
3) We send them the Legal notice to vacate the property. Initially they did not pay attention then they asked for 2 years more period .But we did not agreed and file a civil suit.
4) We also file a complaint to collector with registered contract copy but he send a letter that the complaint is dismissed as this matter is of private land.
Here my concern is : If we have registered contract/agreement, then is this a valid reason to dismiss the complaint?
After completion of the contract it is already proved the trespassing.
what to do in this matter?
5) while doing lease contract my dad had given a permission to electricity board for commercial power supply. Now we put a complaint of trespassing on our land and ask to stop power supply. even after we have a right to stop illegal power supply in our property, electricity board did not do any valid action. Whereas the opposite party submitted false judicial documents as an evidence to prove that our civil suit is denied in court. But our hearing is still going on in court.
Its a clear that the system is managed. kindly suggest what we should do?
