International assignment, Exit formalities, Full & final settlement

Hi, Need help & guidance with my somewhat unique situation. I started with my Indian employer(Global IT Company) in 2007 and had been on many international project assignments. For last project assignment(payroll remains in India) i was sent to USA on L-1B with family in June-2018. As per project assignment contract i was entitled for yearly fly back but it was denied by the manager though earlier he had agreed to overall cost for project assignment. In the month of Dec-2020, i decided to leave Indian employer and take international transfer to US entity of my global employer(L-1B was for US entity of my global employer). Both my new hiring manager & manager that time agreed for my final day on 31st March, 2020 and joining US entity on 1st April, 2020. So on 1st April 2020 my payroll switched from India to US entity. As part of HR policies, had to submit back all IT assets to complete exit formalities but due to COVID and air traffic disruptions my global employer introduce travel ban and hence i couldn't even use final repatriation flight back to India for family and couldnt submit IT assets to Indian entity and hence they are holding up my exit formalities which is impacting my visa extension and greed card application process apart from financial impact. Finally my new manager agreed to pay the cost of shipment and i shipped back via all IT assets to India as asked by Indian entity team in the month of Nov-2020. Unfortunately customs department hold the shipment and asked for additional documents from receiver(Indian entity manager). I have completed all tasks i was asked to do and with shipment still stuck with customs department on which i have no control and facing personal, professional & financial impact due to this. With all background i have below listed questions. 1. Can i ask for repatriation flight now as have left Indian entity and joined US entity and the COVID situation has improved little bit after vaccination availability and looks little safe to travel? 2. How long employer can delay exit formalities and full & final settlement even though employee has finished all task he is asked to? Is there any legal way to force Indian entity to complete exit formalities and process my full & final? Is there an option to ask for additional compensation due impact of unnecessary delay caused by Indian entity? 3. Since the Indian entity isn't ready to help, can i hire a lawyer and file a legal case on Indian entity remotely from USA if possible? Thanks & Best Regards, Hetal
