Clarification on OBC Non-Creamy Layer for serving para Military personnel
Sir, I am presently serving as Sub Inspector(now falls under Group B) in Central Reserve Police Force (Para Military), I was appointed as Assistant Sub Inspector (Group C) during 1992. My question/query is Clause III relating to Armed Forces including paramilitary Forces of Ministry of Personnel, Public Grievances & Pensions (DoPT) OM No.36012/22/93-Estt.(SCT) dated 08.09.1993 states that Son(s) and daughter(s) of parents either or both of who is or are in the rank of Colonel and above in the Army and to equivalent post in the Navy and the Air Force and the para Military Forces comes under OBC and DoPT OM No.36033/5/2004-Estt(Res) dated 14.10.2004 at para No.10 clarified that "income from the salaries and income from the agricultural land shall not be taken into account" to determine creamy layer status. Here I want to clarify that there is not other source of income to me except my salary. The annual salary for the last 3 years varies from 8 to 11 lakhs (as per Income tax returns). Now my question is whether my son is eligible for OBC Non-Creamy Layer, based on my present rank (below Colonel) or in case of salary (which should not be considered to determine creamy layer status) as in my case. Will you please clarify the above issue, so that I can apply for OBC NCL for my ward accordingly, as advised. Regards.
