Property dispute among 3 bothers

Dear Lawyer, I am seeking your guidance regarding a property matter involving my family. We are a middle-class family with three brothers, all of us married and having children. I am the youngest among us. Here is the background: The property in question is my father's house. My father, who has retired from his service, is currently living on the first floor with my second brother. The ground floor is occupied by my elder brother. I do not reside at the property. A few years ago, my second brother took a home loan using the house papers as security without my knowledge. He constructed the first floor and later repaid the loan with financial assistance from my father. Now, as my parents are aging, they are unable to decide how to divide the property equally among us three brothers. They have suggested selling the house and distributing the proceeds equally, including their share. They also proposed that whoever takes care of them in the future would receive their share. The issue: My second brother is unwilling to sell the house, claiming that the first floor was constructed with his efforts and, therefore, cannot be sold. This stance has delayed any progress in resolving the matter. I currently live in a rented house, and as my child grows, I wish to secure my rightful share of the property with my father’s approval. However, when I bring this up with my parents, they suggest that the division of property be done after their demise. I am concerned that my brothers might not agree to sell or divide the property fairly at that point. I would greatly appreciate your legal advice on: How I can ensure my fair share of the property without waiting indefinitely. The legal rights I have concerning the property, given that it is in my father’s name. Steps I can take if my second brother continues to oppose selling the house. Thank you for your time and assistance. I look forward to your guidance.
