Electricity Theft, Greater Noida Uttar Pradesh
I have a house in Greater Noida, Uttar Pradesh
In that house a person stays with his family as a caretaker and work as a labour in the vicinity to earn his livelihood .We don’t charge anything from him to stay there.
He is living there since 2008 .We don’t visit the house regularly and at times not for 2 year, we often speak to the person on phone to check if everything is fine.
Now, on 11th October 2020 we visited the house met the person living there everything was fine.
But from other sources living around learnt that Electricity department has served notice of Electricity Theft .On enquiring from that person we recovered the notices delivered on 16/09/2020.
These notices were dated December 2014, 2017, 2019, 2020 .These notices were issued in my name (owner of the house) despite I never stayed there and electricity was stolen by the person staying in that premises.
Then I Visited electricity department and learnt that they have imposed a plenty of Rs 1.36 Lakh with interest of Rs 49,000/-
When I argued that this penalty should be levied on the person who is staying there and doing an electricity theft. Electricity Department has evidence and pictures of the person residing there.
I want to understand if technically and legally:
1. do I am liable to pay the penalty
2. Whether the case of theft shall/can be initiated on me
3. Can I challenge electricity department on imposing fine/penalty on me or initiating case against me
