Notice period serving compulsion
Hi,
I am working in a limited company and my notice period is 3 months as per my appointment letter.
As per my appointment letter, either side (employee or employer) can give 3 months' termination notice. It also mentions that employer may relieve the employee early than 3 months by paying compensation for balance notice period, but it doesn't mention that employee may also get relieved early by paying compensation for remaining notice period.
Is it needed to be mentioned specifically or do labour laws mandate that employee is also free to leave company as long as employee pays compensation for remaining notice period?
I need to leave my current company while I have completed 1 month notice period. Now I am trying to reach to my HOD, HR Manager and other HR persons over Email, Phone and SMS from last 15 days but no one is responding and I am clueless as to what is happening with my notice period.
Not to mention I have 5 months salary outstanding in my current company and no one is giving any reply about outstanding salary.
Please help me what to do. I am ready to take legal action against my current employer, if law allows me.
