Pay Protection
1.If I technically resign from the post of income tax inspector GP 4600 which is Group C ( I am confirmed employee and will take a lein) to join the post of Divisional Accountant in CAG GP 4200 which is group B post , then , will my pay be protected both are central government post?
2.Neglecting Grade Pay, if we consider classification of post as group A,B,C and D as made by central government , then, I am in heirarchy of joining from lower post to higher post? So whether there is any prescribed rules/ supporting case law where classification of groups are taken into consideration for deciding pay protection and to clarify that the person is joining to a higher responsibility post from a lower responsibility post.
3 Income tax inspector is junior most authority as per income tax Act and even ssc CGLE 2017 notification clearly stated that Income tax inspector is GP 4600 and Group C status.
4.Moreover the department which I wish to Join i.e. CAG of india had passed an internal order dtd. 31.3.2014 stating that pay protection will not be given for appointment from higher to lower grade pay inspite of various dopt OMs favouring such appointments i.e.from higher to lower grade pay.But my case is complicated as discussed above in point 1. The fact that all dopt OMs are released after consulting with cag why such action is taken by cag. Hence, please provide relevant information that technical resignation can be supported by this point that I am shifting from group c to group b post even though issue of grade pay movement from higher to lower.
