Fraudulent execution of regd. sale deed of 30' road face by reg housing society(up coop. act 1965)
Dear Sir,
We are second owner of 30 year old house since 2003. The house is registered as 30' North Face Road. The society has sale this 30' face road to other person by registered dead leaving only 7 feed distance from my house in 2013. This dead came to our knowledge in june 2020
Q. 1 Can Society has right to sale undeveloped land of 30' Road which was already registered with registrar for sale dead in 2003 of my house as 30' north face road.(17 year old house purchased by my father in law in 2003)
Q. 2. The society has executed this sale dead with a memmer whos near by relative is already member of society . Is membership of person is bared whose nearby relative is already a member of society as up co-operative society Act 1965 .
Q.4. (a) There is statement by purchaser that She and her family member do not have any house/plot in this society by a membership, However He is residing only 10 feet away from the disputed land and left side to our house. This house is also owned by his family member bu membership of same society . (b) Second statement is that his family income is not more that 19000 thousand annually in 2013. However His husband is Ex Defence Staff and Servicing Second Job in Income Tax Department. The Family Income was in 2013 more than Rs.19000.00 annually.
What legal required to cancel this fraudulent sale deed. Can a criminal case also be filed for these false declaration through affidavit through police .
