Reduced Retirement Age from 62 to 60 Years
Hi,
I am requesting an answer on behalf on my father
My father was working at NIT, Bhopal as Asst. Director Physical Education (SAS Officer) and his retirement was due at the age 62 years as per the norms of NIT Council. His retirement was due in December 2021, but he was given retirement on attaining the age of 60 (which he completed on December 2019) citing the reason that he does not posses the required qualification (NET/SLET as per the UGC) to continue the services till 62 years. This was done wrongfully as per the UGC the NET/SLET requirement is only for the new recruits and not for the person who are already in the service. All other NITs in India have the retirement age of 62 years and his colleague in the NIT, Bhopal also has the retirement age as 62 years.
Also, as per guidelines the competent should be notified well in advance (at-least 3 months before retirement date), but in this case he was given retirement notice on 20th December 2019 and the date of retirement was given as 31st December 2019. My father has taken a home loan of 27 lakhs considering that he would retire in the year 2021 and he would re-pay the home loan taken.
There is already a Judgement in the similar case where the person was retired in the age of 60 in NIT, Kurukshetra and the judgement (details mentioned below) was in his favor and he was allowed to retire at the age of 62.
