Interim Prayer for reserving vacancies for the petitioners who have challenged the promotion orders

We are petitioners against promotion order (clubbing vacancies positions of three years and holding single DPC during 2013 with a new promotion policy inducted in 2011) and considering EER of 2010 to 2012 for evaluation). Single bench order quashed promotion order and promotion policy in Sep 2014. The company moved to double bench. And the double bench upheld the single bench order of quashing the promotion order but allowed the promotion policy to make effective prospectively. The company did not obey the order of the Court and demoted the illegally promoted junior executives for one day and again promoted them by giving them seniority from the original date of promotion i.e from 2013 with financial benefit. Again, the affected seniors have moved the court challenging the decision of the company. The matter is subjudice. In the mean time, the company have again promoted the illegally promoted Junior executives who were promoted in 2013 to next higher post to GM when the case is subjudice. The company is trying to hold DPC for the same batch of controversial executives by giving them promotion to GM from E7 grade. The Court did not stay for the DPC on the plea of the company that the company wants to promote the affected petitioners against the a positive judgement of the court. But, unless there is vacancy reserved against the DPC, how the company will give promotion to the petitioners in the event the court pronounces verdict on behalf of the petitioners. So at this stage, can we ask the court to stay the DPC proceedings and reserve the vacancy untill the final judgement is pronounced.
