Defend under section 53A of transfer of property act
Hi All,
I have one scenario for suppose ‘A’ enters into agreement of sale with ‘B’ to sell his property in writing for a consideration and given the possession of the property in the year 1985 after making the agreed consideration later on 'B' has done the an act furtherance,‘A’ does not executed the sale deed and he become silent. Later on ‘B’ entered into agreement of sale the property which was in his position with ‘C’ in 1990 year for a consideration and handed over the possession of the land in writing after the payment of aggreed amount. ‘C’ has done his part and paid the consideration ‘B’ does not executed the sale deed. ‘C’ has been in continues position from the year 1990 till now and constructed a house and having house number. both ‘A’ and ‘B’ has expired in between 2005 and 2008 and no one sued ‘C’ in their life time.
Weather ‘C’ can defend under section 53A of transfer of property act 1882 against the legal hairs of the true owners?
Can any one please help on this scenario.
