Demanding a vehicle access to plot behind of my residential property.
I have a 14.5 cent land with newly constructed house in Kerala, with panchayat road access.
Above said 14.5 cent frontage have panchayat road but around 20 % road only linked with my properly. The remaining 80 % covered with some other party’s land. This land is not able to use for any construction/ agriculture activities as it only have 02 meter width. this happened because of during the time of road construction activities.
Both the left and right portion of my land have access/ egress for other parties (neighbors). Those access have 08 and 15 feet wide respectively.
The right back of my property there is a land without a proper access, but above said 8 feet’s left side private access is very easiest way to access the back side plot. Back side plot is doesn’t have any building / other facilities. Owner living somewhere, this land ownership he get from his wife’s family asset partition.
Back side property’s left side nearest plot owned by above said land owner’s wife’s younger sister. That 8 feet private access ownership with younger sister. But both sisters are not in a good relationship.
Now a days back side property owner compel me to give vehicle access to his plot for selling. But I’m not agreed for his demand. And with respect of his request, I’m agreed as 3 feet’s access will provide right side edge of my property with market price, which is near to existing 15 feet’s private access. But the problem is that the way is not connecting to his land and entering other neighbor property. So ‘L’ shape access required. Due to my property dimension wise condition I can’t able to give ‘L’ shape access way. Moreover he not agree above said 3 feet access. He required direct vehicle access.
My property already furnished with boundary wall.
In this situation what will happen if he approach the court?
Is there is any requirement to provide access as he demand?
