Calculation of compensation as pet Land Acquisition Act 2013

Total land 1000 Square yard commercial in rural area acquired by RSEB. Notice U/S 4 and 6 if LA Act 1894 issued in15.09.1993 and19.09.1993 respectively. Possession taken on 08.04.1994 u/s 17 and no compensation paid. Subsequently land was deacquired. High court vide decision dated 03.02.2012 held that land can not be de acquired as possession has already taken and directed to pass award. The award did not passed till 01.01.2014 and was passed on 28.09.2015 and compensation awarded as per Act of 1894 instead of 2013. The reference is pending in District court Karauli Rajasthan. The DLC rate of commercial land in the area as on01.01.2014 is Rs1230/- pet square Feet.The land is within 5 Km of urban area and factor for rural area in Rajasthan is.1.25 up to 0-5 Km.The land was acquired under urgency clause entitiling additional compensation of 75% as per section 40(5) of LA Act 2013.
