annual bonus and paid leave benefits on termination
In appointment letter following is the Salary Emoluments and Benefits written both party i.e. employer and employee is agreed. employer has given other benefits accept mediclaim to employee. Now employer give termination letter to me after 11 months and do not want to give annual bonus and paid leave benefits. Reason given is in appointment letter it is written " These benefits are at the sole discretion of the management and may be revised any time in the future without notice. "
Society has given termination notice on 17/05/2015. Notice period is 1 month. Employer inform me to give handover to new person so that new person can start work from 01/06/2015. I have inform the employer verbally that since from 01/06/2015 as new person will work so please release me and pay my salary upto 31/05/2015 and other due so that i can find other job. as per employer request i continue till 07/06/2015 now employer do not want to pay me the my dues
Now I want to go to labour court to get my annual bonus and paid leave benefits. Is it possible to get this through court ?

Salary Emoluments and Benefits:-
Your salary emoluments will be Rs. 30,000/- P.M. + Rs. 2,500/- Travelling + mobile allowance + Tax as applicable. The Society will facilitate your opening a PPF a/c and will contribute an additional Rs. 200/- PM towards this a/c. In addition ,you will be eligible for Mediclaim, 21 days paid/sick leave, one month emoluments as annual bonus and any other benefits that may be applicable from time to time as per society policies. Apart from this there are 10 holidays in a year, including national holiday. You will be required to attend to your duties during such holidays as well as cover up for leave/ absence of others. You will however be compensated at 150% overtime rate [OT] for such duties. These benefits are at the sole discretion of the management and may be revised any time in the future without notice.
