Background Verification
Hi,
I have a typical situation. I joined a company 5 months ago. During the joining I gave all requisite documents like Educational certificates, marksheets, previous 3 employers Offer Letters, Resignation letters, Relieving letters, experience letters, last employer Salary slips, Form 16 for last 2 years Tax statements/Form 16, increment letters. It’s been 5months since joining the organization, the HR is asking for Form 16 from my 2nd previous employer where are worked for 13 months from June 2007-July 2008. I could give them the Form 16 for FY 2008-2009. But they are insisting on Form 16 for FY 2007-2008. I have raised a request with my past employer but they say they will check and let me know as they might not have prepared the Form 16 because there was no TDS in my salary as it was lower than minimum 2.25L limit that year. I have also checked on TRACES website and they have Form 26AS only from 2009-2010 as that was the period they came with the digitization. But I can see that my salary was reported to IT department for 2007-2008. I had also given a screenshot of that to the HR. I have written to the Assessing Officer, raise an RTI against EPFO for my passbook and raised a request on e-nivaran for giving me a duplicate Form 16 for 2007-2008. I want to asked the learned forum here, can you suggest if I have provided all necessary proof like appointment letter, relieving letter, increment letter, resignation letter, salary slips from 2007-2008, Form 16 for 2008-2009 and tax certificates of both the year should I still be worried. I just don’t have the Form 16 from 2007-2008 which was not issued because I had no TDS deducted which is optional on part of employer as per IT law.
I am still waiting for the employer to dig out my Form 16 from 2007-2008, waiting reply from IT department/AO and RTI for my Form 16,PF passbook details. The HR is making me nervous for that single document. Please advise if there is any other document I can provide instead of form 16(apart from the listed documents above) to prove my income and legally safe. Any help or suggestion is highly appreciated. Look forward to hearing from you all.
