Employer forcing to work threatens of bond
I am employed with a firm in noida. I resigned during my probation period of 6 month. But HR rejected it stating that you have signed a 2 year bond with the company. I talked to the management they said you can't leave before 1.5 year you have bond of this period if you want you can serve a 2 month notice period. I don't want to serve that much time. They said it's mandatory.
I don't have the copy of bond But as I recall it was on stamp paper stating 1 year contract and nowhere it was mention any amount or notice period to be served in probation period but the jurisdiction was Ahmedabad Gujrat.
My offer letter Termination clause say " you choose to resign from your services at Upadpro Software and Services Pvt. Ltd. you will be liable to give Sixty day's (60 advance notice after completion 1.5 years as mutually agreed"
My Probation clause say "" The above agreement is subject to a probation period of Six months depending on your performance. On the successful completion of probation period, you would be absorbed as a regular employee of the organization. The Company however reserves the right to extend the probation period in its discretion. During the probation period, the company can terminate the employment without serving any written notice. If you decide to resign during probation period or after confirmation , falling which the company will be entitled to claim the damages from you."
Help me what should I do I have joining in another company after a week. I have already worked 10 days. I believe the notice period in probation is of 14 days only. OR should I abscond from service.
They are forcing me to serve 60 days which I dont want too...
