Pay protection to PSU (Nationalised Banks) on joining Central Govt. Services
Sir,
1. I was working as a Manager in Dena Bank (Now merged with Bank of Baroda-Nationlised Bank). After being selected through proper channel by Staff Selection Commission through Open Competitive Examination, without Interview, I joined Directorate of Census Operations, Min. of Home Affairs, Govt. of India as Office Superintendent (Group 'B' Non-Gazetted) on 01.08.2018 (as a Direct Recruit).
2. As per the latest DoPT's OM No. 12/3/2017-Estt. (Pay-I) dated 28.07.2017, there are two conditions of admissibility for pay protection to PSU employees viz. (i) Direct recruits through interview, and (ii) The conditions of admissibility shall be the same as stipulated in DoPT's OMs12/1/88-Estt.(Pay-I) dtd. 07.08.1989 and No. 12/1/96-Estt(Pay-I) dtd. 10.07.1998.
3. The conditions of admissibility as per DoPT's OM dt. 07.08.1989 is though DIRECT RECRUIT. Whereas, the conditions of admissibility as per DoPT's OM dt. 10.07.1998 is though INTERVIEW. These two conditions i.e. DIRECT RECRUIT & INTERVIEW are club together as well as individually considered as mentioned above at Sl. No. (i) & (ii).
4. My department declined to my request for pay protection citing reason that pay protection is admissible if the selection is through INTERVIEW only. Also, Govt. of India has discontinued Interview for Non-Gazetted posts since 2016.
Therefore, I humbly pray for your kind guidance whether I am eligible for pay protection.
