Bank sending notice with false information in it
A nationalized bank have sent me notice through advocate to appear in the court and pay up double the amount of loan. The charges are -
1. I have not being paying since 6 months the bank dues … Which is wrong - as every month I have been paying emi amount and I have bank statement as evidence.
2. They had sent 2 cheques - amounting to INR 1,20,000/- without informing me, (which had been given as security deposit) at time of taking the loan. But when they deposited the cheques valuing 120000, the bank owes total of only INR 60000/ - hence I blocked the cheque as it hit my account. If the bank doesn't owe the amount - how can they try to encash it that too secretly.
Previously - Unfortunately due to travel and reimbursement not coming on time- I had failed timely depositing emi on 2 occasions. And when together I tried to deposit - the bank excercised
esi so many times in my account that it was -15000 .. So when I paid 2 months together= 10k, it was -5k in account. I didn't have more that month - next month deposited 15k + 5k to fill the negative, but they had already exercised esi - 20 times till then, and my account was -11k . So to pay that 5k I was having to arrange 15k … 25k together I coudnt manage so I could close this vicious cyclone .. I requested bank multiple times to stop this ESI hits .. so that instead of paying that in fine.. I could [pay in the account. They never did, and asked further compensation for each transaction from their end for those multiple ESI hits. Lastly they asked me - and I paid entire amount with mine and whatever charges of INR 80,000/- at a go. Now total amount was only 70k to be paid to this account- which I was paying as EMI every month. … but the sent those cheques wrongly, and also mentions on notice that I have not paid for 6 months. Which is false. Kindly advise what to do.
