Company Name and logo

I started a fitness center, where i had appointed a person who will look after the management of the fitness center. I did all the investment part last part was about having a good name for fitness center. I wished to have a fitness center from my last name, but it was not good in appealing to crowd so i decided not to use it. Later on me and the management decided to use (XYZ Gym) as our gym name. The management person told me that he wanted to start his own franchise in the same name of the gym. I had got my shop and establishment license in the name of the Gym in january 2014. Later management person had used my logo and got it trade marked in his name in the month October 2014. The management person told me that i can use this logo even after termination of management i can use the name and logo of the gym. now after 5 years when i removed the management of my fitness center, this person is asking me to remove the fitness center name and also the logo. He said now if i want to use the logo i have to pay him 25k per month. I just wanted to know will i be able to hold the name of the fitness center as i had shop and establishment license way before the management person register the name and logo of the fitness center.
