Worker case issue
My previous company turned to NPA and 100 workers and staff were not paid salary and were in verge of loosing the job and were in total darkness and the owners not responsible , two senior staff seeing the employee agony took responsibility of taking the licence of the company for running it three years and bail out the company and get the dues cleared . since company was NPA the two senior started new company and started the operation , they cleared the staff salary and workers salary of previous company and solved the issue 100% , but some associates refused to accept the appointment order of new company and wanted their employment with old company for fear of loosing their gratuity, the new company several time requested them to accept the employment but refused to join, then the new company had given then ultimatum to accept the appointment or they shall not be employed , they refused to join the new firm.
further two staff ensured the well being of their employee for three years , looking in the stability they team who refused to join now went to labour court seeking appointment claiming jobless and labour court issued the order to take back the workers in the new company , but the new company has not come out of debt and cant hire at present and meet their expenses , if I we follow the order in the present situation the new company fears closer more trouble to all workers .. Hence are fitting the legal battle but lower court order is to take them to employment , please guide
