Judicial limits of civil disputes
My father had done business with his partner as working partner. His partner has invested around 9-10 lakhs. When everything not happened as expected he decided to quit the business and demanded to repay the amount he invested. My father agreed to repay but he insisted to pay the interest immediately.
My father and brother was involved in the business and it happened in Chennai. They had paid him 35000 per month for 14 months. Meanwhile the business got fully shrinked. At that time he wanted a promisery note for an amount of 600000, 500000 and 527000 from my father, my brother and myself.
I am a government servant and I was never involved in anything. But he tortured my father by emotional blackmail like your son is not believing you as I am a third person trusting you. It gave me a setback and I signed a promisery note that I ll pay 527000. I argued him that I ll pay after 4 years only since I had already some planned financial commitment. He sent me a legal notice through his lawyer from Nellore (his native) whereas everything happened in Chennai. I didn't consider it as seriously. Now he had sent me a legal notice through court stating that I should appear on 06/06/19 at Nellore court.
Is that possible to do not appear as the case was not eligible to file at nellore?
