Can I enforce buyout of notice period after my resignation is accepted?
Here is the formal explanation of notice period policy in the company guidelines:
"Your employment may be terminated at any time by two month’s notice in writing by
either side or by paying you two month’s consolidated salary in lieu of the notice. In the event
of your serving the company a notice of termination of employment by submitting a
resignation letter, the company shall have the option to waive the notice period partly or
completely without paying you the salary for notice period so waived by the company, and
also to decide whether the notice period shall run concurrently with the period of any leave
which may be due or granted to you. In case you leave our employment without notice, we
shall have the right to deduct as liquidated damages an amount equivalent to 2 months’ salary
from any money or monies that may be due to you. Also on leaving the company without
notice period will get you no relieving documental or financial."
Now my resignation is accepted and I am ready to serve one month's notice. But I want to buyout another month's notice as I cannot serve two months of notice period. Can I enforce the management to accept my buyout in this case?
