Previous owner did not clear loan taken, now bank want to attach my property to get their amount
I have a purchased a house and took finance from Bank and after all legal verification bank has approved and i have got the property registered on my name and i have all the original documents with me including the mother deeds and latest EC is on my name only.
Now some creditor bank has been claiming that the previous owner has taken some loan and did not pay and want to attach my property to get their amount.
This property i purchased from two brothers who got a share of the property thru partition deed from their mother on whose name the property was registered.
i have all the original documents including mother deed and EC of each of them..
The creditor bank claims that the sale deed of the mother name was mortgaged to get the loan. but all original sale deeds are with my Bank who financed me the loan...
What should i do whenever the creditor bank issues notice for attachment...and what case i have to file on the sellers (brothers). an certified deed be used for court to issue an attachment degree???please advise......
