Execution of foreign divorce decree within indian jurisdiction

Rashid is an Indian citizen who got a work visa for a period of one year in the year 2014 at Kuwait after that his work was found to be satisfactory by the authorities and was elevated to the position of Deputy Manager of the concern and the nature of the job was conferred to be permanent in character. With affect to it he applied for residential status in 2016 which was approved by the Kuwaiti Govt. by June 2016. In the mean time he fell in love with an Indian girl Neha and in January 2017 they married and settle their life at Kuwait. The news of their marriage was concealed to their respective family member till June 2017. When the family members of Rashid got informed about the marriage they demanded that their son-in-law should immediately be sent back to in-laws house. Rashid being the only child of family was forced to act upon the direction of the family members and processed the required documents for his wife return to India and accordingly, and her wife return back to Indian within oct 2017. Being from different culture, her wife found it very difficult to adopt the culture of Rashid’s family. She was also subjected to various kinds of mental harassment by her in laws with regard to the following of various religious ritual and stipulations prevalent in India under Islamic law. In the mean time, Rashid at Kuwait got aware about the family dispute and in December 2017 filled a divorce petition against her Hindu wife at the Kuwait court. The court passed the Ex-prate decree of divorce in favor of Rashid. Here in India, Rashid’s wife left her in-law’s house in March 2018 and started to reside with her parents in Kuwait. The foreign decree was sent to Indian court for execution in oct 2018, on the other hand Neha being unaware about these facts and circumstances, filled a divorce petition against her NRI husband in the March 2019 and also procured an order of judicial separation from the court. In the month April 2019 of the matter regarding ex- parte decree was brought before the court for the purpose of execution. The court took cognizance of the matter, coupled the two litigation together and set It for argument at 10th May 2019. Arguments from Rashid to show that foreign divorce is valid
