Fixation of pay of Re-employed ex-serviceman in GNCT of Delhi
I, Suresh Kumar has rendered 16 years and 04 months service in Indian Army as Havildar/Clerk. After taking premature retirement from Army Service on 01/07/1999, I joined service in GNCT of Delhi as clerk on 10/04/2006. I request my department to fix my pay as per Rule 16 " Fixation of pay or Re-employed Pensioners CCS (Fixation of pay of Re-employed pensioner order, 1986. However, as per rule the option can be asked within three month of joining of the Govt. service, but the Finance Department GNCT of Delhi has condon the delay for exercising the option. I wish to fix my pay as Order 16(I).
The Finance Department GNCT of Delhi as asked some clarification about fixation of pay as under (the same is quoted (a) to (c) below) :-
(a) With regard to the proposal, it may be submitted that, pay of the re-employed pensioners is regulated in accordance with Order No 4(a) or 4(b)( or 4(b)(ii) of Central Civil |Services (Fixation of pay of re-employed pensioner)n order 1986, Further upon implementation of CCS (RP) Rules 2008, they pay of the pensioner who retired prior to 2006 and who were re-employed after 1-1-2006 is to be regulated in accordance with GOI DOPT OM dated 5-4-2010. As per GOI, DOPT's OM dated [deleted], the MSP is not reckoned in the pay fixation on re-employment and it need to be reduced from the pension.
(b) Further, vide CDA (Pension)'s Circular No 555, OROP has been implemented which would be revised after every five years, As per O/O Principal CDA(Pension) 568 dated [deleted], the pension has been delinked of qualifying service of 33 years for pre-2006 Armed Forces pensioner w.e.f. 1-1-2006 shall not be less than 50% of the minimum of the pay in the Pay band plus Grade Pay corresponding to the pre-revised scale from which the pensioner has retired/discharged including MS Pay and X Group Pay, if any, without pro-rata reduction of pension even if they had rendered qualifying service of less than 33 years at the time of retirement. The revised table indicating the minimum guaranteed pension has been annexed with the circular.
(c) Hence, the Finance Department GNCT of Delhi as asked the clarification as to whether the pay of all those re-employed LDC are required to be re-fixed as and when military pension is revised/enhanced.
It is therefore requested to clarify whether the pay of all those re-employed LDC are required to be re-fixed as and when military pension is revised/ enhanced. Please endorse any such type or order if available with you so that the query of Finance Department can be settled and my pay can be fixed.
Sir, As per Rule I have to ignore DA on my full pension after ignoring some portion (i.e. Rs. 15/-)At the time of joining of my service my pension was Rs. 4009/- and now I am getting the pension of Rs. 21480/- if the pay will fix only 4009/- that I have to ignore D.A. on Rs. 21480/- and I shall be looser.
