Car accident

Hi, I was driving car and was taking right turn to get into a restaurant. I gave proper indicator and was waiting in the middle of the road to turn right. I was hit by a bike (Royal Enfield) from front on the right side (driver side). The bike skied and hit a tree. The biker and the person behind him got his hand and leg fractured. The bike was without number plate (seems it was new). The rider was not wearing helmet. The impact was so huge that it damaged by chassis which in turn opened both the air bags. I was saved luckily due to air bags with bruises on hand and face. I managed to come out of car called ambulance. I called my wife to the spot as village people had gathered there. We rushed them to hospital. Their relatives rushed to the hospital. They started hitting me and my wife but at that time few other folks intervened, and we were luckily saved. The civil hospital was not equipped with fracture treatment, so they were moved to main hospital (60 kms away). I was taken to police station and constables were sent to spot to examine the situation. The constables came back saying they were drunk and was not able to manage the balance. Please note, police did not do any alcohol verification for them or to me. There was no charge filed against me and I was released that day. However, the next day police took my car, car papers and my license into custody. Its been 8 days now but there is no charge till date but police is just buying time, seems to extort money or possible waiting for them to respond. Points to note are: 1. I possessed Learning license (but I am not new to road, I owned commercial license for 6 years and as there is no option to switch directly from commerical to non-commercial license) I had to take the route of applying for new non-commercial license. 2. My motor insurance was expired. My questions are below: 1. What will be charges against me for using learning license and not having motor insurance? 2. Is the police at fault for not doing alcohol test? 3. As there is alcohol test done, are the bike riders at fault for rash driving, riding bike without number plate and wearing no helmet. 4. As the alcohol test was not done, people witness has any weight? 5. Can there be charges levied on them for hitting me and my wife? 6. Why is police holding back my car and papers?
