Requested cancellation of Club Jiva membership but they are refusing to refund my money
I was on vacation in Goa from 14-Feb-2019 to 17-Feb-2019. I was approached by an agent in the Calangute area on 15-Feb-2019 claiming to give a gift by scratching some cards on the celebration of the anniversary of Club Jiva. Upon opening the gift card, I won one of the four gifts, an iPad, an LED TV, 10k in cash, or a paid vacation. All I and wife were asked to do was to attend a 1-hour orientation session at a hotel in Goa so that facilities could be demonstrated to us by Club Jiva staff. We were asked to show ID Proof and Credit Card to claim the gift. When we asked why the credit card is required, we were told by Club Jiva staff that they have a tie-up with Visa/Mastercard and the gift is sponsored by them. The receptionist checked the ID proof and credit card details and then we were allowed to attend the presentation strictly for 1 hour. After we stepped into the meeting hall of the hotel, we were introduced to a sales agent named Tejas. We came to know only at the end of the presentation that Club Jiva wants us to buy membership and offer is valid only on the same day, 15-Feb-2019. We were made to pay Rs 1,80,000 for the membership stating that club Jiva has a tie-up with Visa/Mastercard and the membership is sponsored. We were given a false picture that the Club Jiva membership which would entitle us to cheap accommodation in 5-Star properties across the world. Finally, with the misrepresentation and false commitments, we were sold a membership of Rs 1,80,000 for a tenure of 25 years on the spot. On returning back to our hotel, we did some more research and realized that they had no tie-up with Visa/Mastercard. We also requested our bank to hold back the transaction done on the credit card but to no avail. We also dropped an email to club jiva the next day asking for cancellation of membership and refund but they did not respond to our request. We also approached the same hotel in Goa on 17-March where Club Jiva team met us. We requested for cancellation of membership and refund again on 17-Feb 2019 but we were denied any refund stating that there is a clause in their agreement that denies cancellation of membership which they had made us sign under pressure on 15-Feb 2019. We have realized that we were cheated by club Jiva in a professional way and they made us sign all the documents by misrepresenting facts in the presentation. We have the following grievances that need redressal:
1) Misrepresentation of data such as owning 32 resorts across India.
2) Misrepresentation of promotion from Visa/Mastercard.
3) Misrepresentation of fake people from Visa/Mastercard to provide gifts.
4) Misrepresentation of tie-ups with the major hotels in India and abroad.
