Ugc incentive increments 2010

I am to inform you that i am basically M.com ph.d., and in the pay band of iv. i.e [deleted] plus 10,000 AGP. I have completed MBA in first class in the year 2011. As per GO. no 38 Government of Andhra pradesh says that revised Guidelines comes in to operation w.ef 1-9-2008. Earlier i was given Ph.d increments. As per AICTE clarification M.Com comes under higher education and MBA is technical qualification. G.O no 38 para 2.7.7 says that a person who acquired M.Phil or additional post graduation qualification duly recognized y a statutory body/council or university while in service is entitled for one advance increment. I am in Pay band iv at the time of doing MBA. I was given pay band 5 w.e.f 1-1-13 under CAS. faculty members who acquired additional qualification while in service is entitled for one increment irrespective of the fact whether they are in pay band iv or V. UGC norms says that any faculty is not entitled for advance increent if he reaches pay band Iv. How far it is justifiable and legal validity. Am I entitled for one increment or not.Please clarify. is there any court judgments on this subject Dr. A..SATHISH BABU
