Inheritance of wife's property by husband
I am 82 years old. My wife died intestate during 2016. We have no children. We lived continuously for 43 years in a property inherited by her father as a result of a partition suit. On the death of her father around 1974 the partition suit declared the 4 sisters and mother as the defendants and subsequently around 1980 on the death of the mother the property was mutated into the joint names of my late wife and her 3 sisters and is registered by Kolkata Municipal Corp. Property Tax has been paid up to date.
The 3 living sisters now want to rebuild the property and have stated that as my late wife and I have no issues I have no right to owing her share of the property and has quoted the Hindu Succession Act 1956. - Is this correct ?
Secondly My wife (until her death) and I lived in and have continuously paid municipal tax and electricity since 1976. About half of the property is rented and with the agreement of the other owners I use the whole of the rent for house running and personal expenses. Can I claim any part of the property as a long term occupier ?
Any clarification would be appreciated.
