Removal of members from Flat owner's Association
By virtue of my purchase deed of a flat from the promoter builder, I became a member of a Flat owner's Association registered for the purpose of maintenance of common assets /amenities. Though the builder promised Transportation, common dining, CCTV, water connection etc.none of them were given. When the Association was asked to take up such common matters with the builder, the office bearers refused for whatever reasons not shared publically so far. Also, transparency was lacking in the functioning of the Association in using funds. when I insisted for verification of accounts it was resisted initially though bye laws permit members of such inspection. Finally, I prevailed upon them with the help of the regulatory authority, The Dt. Registrar. When irregularities were noticed and questions raised, the office bearers convened a Special General body with a mere 50 numbers of mostly residents who are not members as found in the Register and reportedly passed a resolution to remove me from the membership. Thereafter they stopped all communications including circulars about maintenance and other activities. The TN Apartments owners act , Societies act etc do not have any provision for the expulsion of a flat owner.Please advise the remedy including the damages for reputation.
