Land acquisition
In 2010 my agriculture land was acquired for national highway in Bihar, now when NH-30 build under BOT, and toll plaza is also taking toll on that highway. When I measured my land in 2015 after build NH, I found some more area(1500 sqft) was acquired Extra (by wrong measurement,) as compaired to notification, I have complained they are still busy with state authority in Letter for 3A approval for Notification.
My qs is –
1- Can I Demand for Commercial land rate because they are taking toll for using that highway and this is commercial activity.
2- My neighboring land was sale in 2017- 18 as commercial land (because touching NH). And after NH all land on NH is selling commercialy.
And I am still owner of that small part(land) and according to new Act market rate will be decide on notification date.
But the NH officer and local authority personally said to me that in 2010 when your land was acquired that time it was agriculture land so we will pay agriculture rate.
Can i legally demand commercial rate.
