My company is trying to terminate/ considering me as absconding even after submitting my medicaldocs
Hi Sir, i am an employee of Wipro Bpo at Hyderabad. Recently i meet with an accident and was on medical leave for a month after undergoing surgery and then resumed to work and i worked for two weeks. On the third week my injured forearm started aching and swelling because of which i couldn't work. I have requested my manager for one more month of leave but they rejected it and when i asked if they can provide early exit medical grounds if i resign. They said they will be looking into it if i resign. so i have resigned on medical grounds. On December 3rd my forearm was aching and swelling and i couldn't bear it so i have left the Organization with my Team Lead's approval and when i went to doctor after three hours he said that the aching and swelling would be common untill the bone gets heeled and after examining the x ray doc said that my injury might lead to NON UNION OF BONE syndrome. So to take better care of my injured hand i wanted to take leave and informed the same to my Team Lead but she asked to drop a mail for early exit and i did the same.
The next day my Team Lead has called me and asked to resume to work while the verification of medical records takes place for my early exit. I replied that because of my medical condition I cannot resume to work but she was not ok with that so i said i'll talk to HR regarding this. When I tried to reach HR on this on phone he didn't respond so left a message to call me back or suggest me the best time to call him. But he didn't reply and i have calling him up and texting him to respond but he did not respond for 17 days. In between once he took my call but was not audible so he texted that my medical records are under process and he will get back once there's any update.
So i called up my Team Lead to knew the status of my medical exit then she replied that as you have not showed up to office when you were asked to, you are being terminated on that basis. I said as i am unable to work because of my medical condition how can i come to office.
After long try i got talk to HR and he said that was being considered as absconding. When I questioned him on why am i being considered so.He deaf heard it and said you will be getting letter on why you are being considered so.
Now my question is despite me submitting my medical records and asking for early exit how can they consider it as absconding when HR did respond for such long, to explain him why i cant come to office.
Please help me on how to proceed further to get my relieving papers with clean exit.
