My case is about unpaid Salaries for last 3 months and forceful termination without formal notice

My case is about unpaid Salaries for last 3 months and forceful termination without formal notice. I am working with a Pvt ltd Company based out of Gurgaon and my base location is in Mumbai and work area is West region and also handled south region as well. I haven't got paid my Salary since September 2018, October 2018. When I followed up with company for, I got terminated on 20th November 2018. As per agreement company gave me notice period till 20th December 2018 and said my dues will be cleared by 10th January 2019. Reason for termination was to right sizing company due to financial issues.Company is doing good business in west and South region. I havent got salary on time since I joined i.e. from Feb 2018, and every salary use to get credited after 20th of next month. After termination company HR dept neither picking up my calls not reverting my phone calls, my personal mail ID for communication is blocked, so I created new mail ID and asked for salaries and my dues still no reply. I have query whether I should get all dues cleared on my last day or by 10th of January 2019, as said by company on mail is true. Can I file case against company in Mumbai, as head office in in Gurgaon and Delhi Jurisidiction area. But my working area and base location in company is in Mumbai? can company deny to pay all dues on grounds of financial reason? what kind of reply company will give and how long it will take that company pay dues? DO company representative have to be present in court of case proceedings in Mumbai?
