Health insurance exclusion
The insurer in the health insurance has put this exclusion clause” 10% loading in view of dyslipidemia and No benefit shall be payable to Mrs XXXX under this policy in respect of medical expenses being incurred arising directly or indirectly due to Dyslipidemia including investigations, treatment or direct complications thereof for a period of first 3 continuous years from the date of risk commencement.” Till date I am arguing that this clause is unilateral and there was not written consent take from me for this exclusion from the insurer. Are clause like this acceptable under law, are they not unilateral protecting only insurer not the insured. This insurance is for a senior citizen aged 61 years. Till date the insurer is not explicitly explaining the exclusion in spite of me complaining to IRDA. Want to explorer if the clause is correct and can this be taken in consumer forum. I am asking them to explain what is directly and indirectly in exclusion, but till date there has been no specific response from insurer. Can such clause be acceptable under insurance exclusion.
