Pending criminal case

Sir I am quoting a tender which has a clause as under 1. The bidder is required to furnish an affidavit that no criminal case or fir is pending or on going in any court regarding the works executed by us/me or is under execution 2. The bidder should not be convicted Sir we have a pending FIR regarding a work executed by us in which charge sheet has been framed but the Punjab haryana high court has stayed the proceedings in trail court We have filed quashing petition in high court on the basis of SIT conducted by vigilance dept after the FIR was done and before the framing of charges. In the 5 member SIT the I.O who initially did he FIR was also a member. The findings of the SIT proved us innocent and no charges as mentioned in the FIR were proved during the findings of the SIT Sir now I have to quote this tender and can you specifically provide any judgments regarding the same as the department is of view that if the bidder can support that merely FIR or criminal proceedings cannot disqualify the bidder then they would not disqualify. I want the judgements with specific findings on the above stated matter. Kindly do the needful
