Termination during Probation Period
Okay, I am a Chinese working for this Indian company. My employment visa expired hence I was not able to perform my job but wait in the head office for my visa extension to be granted. note that my other Chinese colleagues were getting paid as normal during this same waiting time. So, It was at the end of last month 26th Sep 2018 I told the HR team that due to the family issue I had to leave India as soon as possible but not knowing exactly when because of my visa and frozen bank salary account. So there was no specific time of leaving or a written resignation form from my side was given.
Today 13 Oct 2018, the Head of HR told me that the company will not pay me after 26th Sep 2018. So I told him that it was not fair as I was not informed on 26th Sep or right afterward, instead, 15 days later.
Should I know that I would not get paid from 26th Sep as he said, I would have not gone to the office as I was doing.
On my contract, it says DURING PROBATION PERIOD IF MANAGEMENT IS NOT SATISFIED WITH YOUR PERFORMANCE AND CONDUCT, YOUR SERVICES SHALL BE LIABLE TO TERMINATION WITHOUT NOTICE AT ANY TIME DURING OR/ON COMPLETION OF YOUR PROBATIONARY PERIOD.
so my question is that 01 does my company has the right to stop paying me from a time they said, instead of the time that I actually stopped working.
02 what rights do I have over this resignation during the probation period.
