Regarding Retrenchment Benefit
Dear Sirs and Madams,
I am facing some problem by my present organisation .I need your help and request you to clear my all queries very soon (if possible today) as I dont have time to take some final decision. This situation for all employees who Retrenched by my organisation. For your information, our organisation sold their East and North paart to one organiaztion which is smaller compare to present organization. They offered us job but not taking us as a permanent employee. Our organization till now not share date of handover by any official mail. Till now not received any official mail or notice from my present organization. Termination notice period for our organization is 2 month but they are telling they will not give single rupee of severance pay as they arranged job for us. I claimed few things which I am eligible, I feel. Please find below claim and confirm me that am I eligible for all claim or not . If yes then confirm or if no then also confirm me and also tell me how to take legal step if require.
Please find below claims and request you to share your guidance.
1. All the employee will get Gratuity till last day of the organisation as all employees would like to work for 5 years but company request us to leave the organisation for some internal issue.
2. All the Employees will get paid for their all Paid Leaves .
3. All the Managers will get Variable for AMJ’18 , JAS’18 & also if pending any other previous quarter .
4. All the Managers and Executives will get all pending monthly/ quarterly/ weekly incentive.
5. Company will pay all due double pay for holidays to all employees.
6. We will get Diwali Bonus with our FNF .
7. In FNF also we will get payment for all due travel claims , Mobile reimbursement , sodexo and other due expenses if any .
8. We will get offer letter from new organization with 1 month time for acceptance. Till that till we are employee of Currents or Currents will pay Salary of 1 month as a notice period.
9. Offer letter will come with minimum 10-15% increment as Currents not giving any increment in this year. As per given commitment we can understand they will not ask us to leave their organization within 6 month after joining . Also they will offer same designation or higher designation.
10. As per company policy and labour law act , we all are eligible / get for severance pay of 2 months full salary or more as company requested us to leave.
11. We will get official requesting letter for leave the organisation from Currents HR team with sign of our MD.
12. All the FNF calculation, we will get before asking signature on acceptance letter of leave the organisation and on offer letter of Tresor.
13. After acceptance of reliving letter we will get experience letter from Currents.
NOTE: Now I am with my present organization . But now If I am willing to serve 3 month notice period then also they are telling they will not accept notice period and not give salary of 3 months.
