Exam cancellation reg
My exam in one subject in final mbbs,despite myself passing the exam after evaluation by examiners got cancelled by a private university in February 2017 for malpractice allegation. Aggreived, i filed a WP in Madras High Court in April 2017.It got dismissed in June 2017.I filed a WA in Aug 2017.It got dismissed.I filed a Rehearing ( review) petition which kept on delayed for 3 years and got dismissed in December 2020. Meanwhile, i passed the cancelled subject in December 2017. Now i got my degree and registered myself as a qualified doctor. The Respondent did not prove that i have copied, the Exam Disciplinary Committee which recommended cancellation of the subject did not conduct an enquiry with me to explain my stand as promised by the Dean. The allegation against me was that i was found having a smart watch with internet access. We have disproved in the Court that watch did not have any smart functions including access to internet on that day. As per the exam manual rules , no disciplinary action has been initiated by conducting an enquiry with the candidate and none of their exam manual rules were followed by the University was proved by us in both WP , WA and Rehearing petitions. But, still our petition is dismissed by saying that bringing the watch itself amounts to malpractice. Cancelled subject and break in the academic year is a hurdle for me to pursue my postgraduate studies abroad. Rehearing petition conducted by a Division bench in the final hearing had only one judge instead of 2 judges and the judgement has been delivered by the absent judge on the final hearing.
Questions:
1) Whether one judge can hear in a Division Bench and can judgement be delivered by the absent judge on final crucial hearing? If not, what is the remedy?
2) What about the chances of this case in Supreme Court? If we win, whether Supreme Court can revoke the cancellation order and can order the University to rectify all mistakes of the University? so that my hurdles in pursuing my PG studies abroad will not be there.
3) After obtaining the order copy, within how many days ,appeal to be preferred in Supreme Court?
4) What is the maximum and minimum relief i can get in Supreme Court in this scenario?
