Interim suspension still continues or expired after 6 months
Wishing you the time of the day.
Maam,
A Rectification deed was executed by my Grand Father unilaterally Rectifying one of the Boundary as Donors Land instead of Common Road in the Gift Deed gifted to my uncle as it was mistakenly printed. later on that land along with the land behind it was registered in my fathers name through a Gift deed. My Uncle who was well aware of the Rectification deed and tried to stop it by filing n no of applications to the authorities but to our sheer good luck the rectification deed was registered. Later on my uncle filed a writ asking to suspend the rectification deed as it was registered unilaterally without any notice to him. The Hon'ble High Court of Hyderabad gave interim suspension saying
" Therefore there shall be interim suspension as prayed for" and asked the Sub Registrar to file the counter which they didnt file till date.
the order was dated 30 november 2017 and now it has been almost 9 months.
I came to know that as per the orders of the Supreme court any stay which does not have a hearing order of time expires within 6 months.
But some advocates told me that it does not apply to my case.
so, I am confused.
Please guide .
Thank You,
