Delay in medical board for assesing extra ordinary leave
I am working as a gazetted class 1 officer in a central govt department. I have been on medical leave since June 2015 . 6 earned leaves were granted. But could not join back due to severe health issues. I had earned leaves balance due to which I kept getting salary till October 2015 and kept sending medical certificate for rest advised by govt doctors to my office.
When my earned leaves ran out I applied for EXTRA ORDINARY LEAVE.To which my office called for a medical board opinion.
The hospital to which they referred me has been delaying my medical board for over 2 years now. Finally I have appeared in front of the board this year.
They are advising unnecessary tests and dragging it even longer.
I am under service bond of 5 years failing which I'll have to pay 10 lakh. I had completed 4 years in service up to October 2015.
I need additional 1 year to get rid of the bond.
Now, if this board declares me FIT and undeserving of extra ordinary leave on medical grounds based on my health status right now which is different from 2015-16 when the board was first ordered.
Will the delay caused by the hospital account as service for me as it wasn't my fault ?.
I don't want to pay 10 lakhs as I'm not in a position to do so. I have been without salary for 3 years now.
