Partition Suit

Dear Sir, I will not make the matter lengthy. Just need a prima facie reply In the year 1979 we all use to live in a joint family. The Family consisted of my grand father & his three sons. During those days they purchased many immovable properties (Residential & Commercial). In the year 1991 they made a family arrangement (FA) & upon the basis of that FA Arbitration proceedings started wherein all the properties in the FA were dealt with. Our share of Residence property was claimed by us as & by way of counter claim which we filed in the Arbitration proceedings. But in the Award dated 1st April 2013 our claim was rejected. Hence we filed a petition challenging the Award which is still pending. One of the son who was the claimant received his properties as per his claims in the award. Now the issue is, The residential property which we stay in was a family property & was purchased by my grand father on one of his sons name(Claimant in Arbitration proceedings). For the sake of convenience rent documents were made in the name of other sons to stay in the said premises & we were shown as tenants. Now since we have not got our rights in the residential property in Arbitration proceedings as per the FA, can we now file a partition suit for the residential premises where we stay. The property is in Mumbai & governed by Maharashtra rent control act. It is a admitted fact in the Arbitration that the property was purchased by my grandfather in one of his sons name & which belongs to the family. How can i approach the High court & file a suit & will i succeed in admitting the suit in HC? Please please clear my doubts, & if there is anything you need to recheck with me, please reply.
