Possession of land
1. Undersigned came to know that Sh. Dilip Kumar who had commercial plot -1 on lease from housing board wants to sell the plot further.
2. Transfer charges as per HIMUDA norms were deposited to HIMUDA account on dated 04.10.2017.
3. HIMUDA released an order on no. HIMUDA/Commercial Plot No. 1/ Dhaundi -Mandi / Admn dated and all the lease hold rights were transferred in my name.
4. Complete payment to HIMUDA was made on dated 13.11.2017 & 16.11.2017 respectively.
5. The lease agreement was registed at Balh Tehsil on dated
6. Symbolic possession of the plot was given by HIMUDA Mandi office on dated vide letter no.
7. The work for construction was started in the month of March 2018.
8. Owner of adjoining land conflicted on site and hence a letter for physical possession of property was given to HIMUDA Mandi vide letter no. Plot / Personal / Mandi / 2018/ Dated: - 26.03.2018 and copy of letter was also forwarded to HIMUDA Circle office Dharmshala as well as to CEO HIMUDA Shimla.
9. Since no response was received; reminder-1 vide letter no. No.:- Plot / Personal / Mandi / 2018/02-04 Dated: - 03.04.2018 was again sent to concerned authorities as mentioned at sr. no. 8 stating that construction of the plot has been started but boundary dispute is still there and but people are not allowing me to construct boundary wall and drain line.
10. Again no response was received; another reminder-II vide No.:- Plot / Personal / Mandi / 2018/02-04 Dated: - 11.06.2018 was served to the authorities.
11. Telephonically discussed the matter with SE Dharmshala and Executive Engineer HIMUDA Mandi for resolving the dispute. But again nothing concrete was done by HIMUDA Mandi and asked me to keep patience.
12. On 15th August concrete roof was constructed but no chajja was built on the backside of the commercial complex and drain line was not built as people were threatening to destroy the chajja structure and drain line if built.
13. This was also communicated to executive engineer HIMUDA Mandi division but I was told to keep future scope for chajja till the dispute is resolved.
14. Since nothing was the outcome despite of my request letters to HIMUDA since March 2018.
15. Another letter was written to HIMUDA authorities vide letter no. Plot / Personal / Mandi / 2018/05-07 Dated: - 27.08.2018 and in parallel RTI was filed to HIMUDA on dated 27.08.2018.
16. The owners of private land were asked many times telephonically to let me construct the structure as per approved drawing and the matter of dispute shall be resolved by HIMUDA in due course of time but they denied.
17. The response of RTI is as attached.
18. All the documents as mentioned above are attached herewith.
19. Actual dispute is of HIMUDA and owner of adjoining land but I am the sufferer.
What should i do to get the complete property in my possession without any hurdle and future problems if created by private land owners?
