Land acquired by government for new road.
Dear Sir / Madam,
This question is related to current case we have filed in the court . We have filed this case demanding more compensation from the government.
Initial very less compensation for the land was given based on 2008 land valuation. Later on an petition was given to district collector stating that compensation should be given based 2012 land valuation and that additional amount is sanctioned.( We did not receive the sanctioned amount because we have filed the case ).
The land is agricultural land in the village.But the land is very near to the township area. The compensation provided was very very less if it is compared to the township area. The case is filed based on the point ( told by the lawyer ) that the land is near to township area so the compensation should be given based on below two criteria.
1. The compensation should be given equal to the any land registered in and around the area of the acquired land in last 1 year. ( current value for land in that area is very high than the given compensation).
2. Township is within 1 km radius of the acquired land. Hence the acquired land should be more compensated.
My doubt is that whether the above points is valid to file this case . The case is currently in local civil court. Lawyer is telling if the court is not favoring us , we can appeal in the high court. Kindly clarify whether the above points are valid. If we appeal in the high court will there be anything favorable to us to get additional compensation. If not we wont appeal .
