Passage is not gair mumkin nor common nor gali sareaam

Sir Hi, There were 4 plots in mushterka malkan land. 5.5' area for passage was left from each plot and 11feet path was made so everyone can approch their homes. Two plots are at front and two are adjoining aur backside. Now one owner who has a plot at my back had purchased the plot abutting the passage at back side and he is the owner of two plots which were at back. After that he want to raise a gate in the mid of passage where his area starts by claiming that as he has two plots at back and 5.5 feet passage was left from his each plots so that is his own area and he want to merg it in his plot... Also this passage falls in khasra number.... Lower court degree the suit in aur favor that it is a gair mumkin rasta and no gate can be installed on the same, but Session judge allowed his appeal and said that the passage is left from his own land and the passage is private passage. Now he installed his gate. Sessions corut in his order said that the passage is private passage and its not gair mumkin rasta nor common rasta nor gali saream. Now my question is thoat when it is private rasta can I construct wall on my 5.5 feet passage which was carved from my plot...there is no agreement that he has purchased 11 feet path (each 5.5 ') from me and 4th owner abutting my path.. ... and if we both merge aur area of passage, who ll he go to his house bcoz there is no other path..... He can only go by jump and hop from place to place... He is serviceing in Police so he threat us. This passage was left for common use by mutual understanding... secondly by enccroching the passage he had taken his whole share...Now pls advice me that can I cover my area of passage left from my plot.
