Forceful transfer by Company
I am from a small town of Karnataka & don't have proper understanding of Hindi & Rajasthani. I have been forcefully transferred by HR of my company to Jaipur without any intimation & information. They just posted transfer list & my name was there. From next day itself, they have stopped my attendance in Bengaluru (where I was working currently). My job requires Coordination & communication with channel partners which is mentioned in Job Description.
Along with the same, under transfer policy of my company, it is clearly stated that HR will transfer employee to department/location based on their capacity to handle new role. Along with the same, it is written that sufficient amount of time will be given to employee for movement.
I have a bond of 2 years in company or 2.5 lakh rupees which I have signed; over that it was written that company can transfer employee to anywhere based on business requirement.
As HR forced me to join Jaipur very next day without giving any sort of previous intimation/information & have violated company's own policy to give sufficient amount of time.
At the time of joining, they have asked us to enter a lot of details on their portal as well as have filled manual forms where I have not written Hindi/Rajasthani under Languages known. I have written Kannada, Telgu & English as my known language. It is mentioned in company's policy that employee should be capable to handle role & under Job description, it is written coordination & communication with channel partners. As language is a tool for communication; thus, I will not be able to communicate & coordinate with channel partners.
On these 2 aspects, can I send a legal to notice to HR as a person (not to company) for mentally harassing me by misusing his authority. I want to target person not company because once I raise question on company, she will be taking help of legal department of company & I will become weak.
Kindly guide me what can be done in this case? I am a fresher, joined just 1 year back.
