Refuse to appeal

Hi there I am working for Amazon in Seattle WA as a software engineer. I believe my manager violated multiple laws. Then I have sent a complaint about this to HR and to the Equal Emloyment Opportunity Commission. As a result of that, Amazon HR performed internal investigation. HR confirmed some of the facts but they said it is neither violation of Amazon policy nor the law. Equal Emloyment Opportunity Commission did not start the investigation yet. Immediately after the end of HR investigation, my manager placed me on the "pivot". (https://www.bloomberg.com/news/articles/[deleted]/amazon-workers-facing-firing-can-appeal-to-a-jury-of-their-co-workers) Soon I will face an appeal procedure as it is described in the Bloomberg article above. I understand, that according to statistics most probably I will lose this appeal. During the lawsuit, I will tell to the judge, that they fired me as a retaliation because of my complaint. Then Amazon will use my appeal failure as an evidence during lawsuit case. Amazon will argue that they fired me because of my performance. And evidence of my low performance is that other colleagues confirmed this during the appeal. Could you please advise: - Can I just refuse to appeal? I understand that Amazon offer me 3 choices: performance improvement plan, appeal or dismissal with lump payment. I will tell them: I choose neigher of them. I choose to continue working in normal course. I am employee at will and I was not hired to participate in humilitating procedures. I was hired to write a code. - What are the risks of this decision? - What are the links to applicable laws?
