Can I take Legal Action against my employer, for asking me to leave the Job
I am working as a Sales Manager in a Bangalore based company; it's a reputed firm. This company launched new division 3 years back; the old team didn't do well and we have been appointed to develop the business.
My challenge was in recruiting manpower, since the old employees started spreading bad news about the company, we were not able to bring new people; my management and my manager also knows this. There were even 4 Manpower consultants were also helping us to recruit manpower; nothing worked.
Meantime, my management wanted to start one more small division focusing on 2 products; I have been assigned the job, we moved a person to head the small division; with lack of support from management, the business also didn't go well; now the person been transferred to another division.
Meantime, 4 months back, my manager appointed a new guy to handle a different vertical and removed all my major outlets from me and attached to the new team; now since the major business comes from the top outlets, which is moved to another vertical, all my stockiest are not interested to continue the business, hence the business had further went down.
Two months back, my manager called me, & my team for a meeting and asked us to stop focusing on the business. He mentioned that he doesn't have any further plans on me and my employment. I got confused and given him a written resignation letter dated 1st Aug'17.
The management is biased; there are people taken money from stockiest and not paid; I escalated this as a complaint to my management; no actions taken against that employee...
As per the Travel Allowance policy, I am not eligible to avail CAR expenses while working local market, whereas the management allowed the low level employees also to claim car allowances in other market.
The company doesn't have any standard KRAs and Appraisal system; they are not disturbing the people whom they like and they are collecting resignations from the people whom they don't like...
As I joined this organization in 2016; other companies are thinking that my duration with the new company is only 1.5 years; getting a new job is becoming very difficult. Now that my career is in stake...
In my situation; can I call back my post dated (Written) resignation and go legal against the company???
Please suggest for me to take a decision...
