Degree validation by honable supreme Court but still there are issue
Hello Sir, I graduated from Sikkim Manipal University (BCA 2007-2010) from study centre in Jaipur. During that time there was no question of violation of territorial jurisdiction by the regulating bodies (DEC-IGNOU-UGC) which is dissolved now and full power is vested on the hands of UGC. Eventually UGC (highly incompetent body) started to create nuisance, stating all those degrees outside of Sikkim is invalid. This created a wave of agitation and led the matter to (Hon’ble High Court of Sikkim in WP(C) 4/2013 titled as Sikkim Manipal University Vs IGNOU & Ors). The outcome was that Hon. High Court upheld the UGC decision of immediate close down of all study centres outside state of Sikkim and also protected the degrees of the students who were enrolled till the date of court judgement, as the order won’t have a retrospective effect. On the validity of degrees, the court said that students whose degrees will be ‘protected’ include those who had completed their course before 2011-12; others who had started their programme prior to 2011-12 and those admitted for the programmes any day after February 22, 2013, till June 26, 2015. UGC after this decision filed a SLP (C) No. 26223/2015 & SLP (C )No. 26239/2015 in Hon. Supreme Court which was also dismissed thus protecting the students degrees, and instructed UGC to upload the judgements in their Website within a time frame. After all these mess UGC at last uploaded the judgements in their website. I filed an RTI against UGC and they replied that my degree is valid (although in DIPLOMATIC way) . My concerns are that 1. After these court judgements is my degree valid now in the eye of Law? 2. Can anyone be in denial of Hon. Supreme Court & High Court orders? 3. If someone (Govt. /private) denies these validation of degrees what are the provisions left for me? Do i have to move to court again?
