Non payment of salary and earned leave encashment entitlement etc
Dear sir,
I was working in a CA firm named Janaswany Associates located at Sion from last 8 years.
I have joined this firm as a fresher at salary of Rs. 5,000/- and based on my good performance same was increased to Rs. 10,000/- after 1.5 years. After 2 years it was increased to Rs. 15,000/- after few days of negotiations.
At that time i was getting only fixed salary and annual bonus. I was not covered by EPF and since i had no idea about its applicability, i had not asked for it from the firm.
Before 2 years, my wife also joined this firm and she was covered by EPF compulsorily. I checked then from department but they have not provided any information and neither provided me Employment policy of the organisation on demand.
Partners of the firm had started me embarrassing so i decided to quit the job. I requested firm for my Earned Leave Encashment but they denied for the same. There was little argument regarding the same and i was asked to continue job during notice period. Thereafter one of the partners Mr. Shankar Narayan alluede me for good increment if i continued.
I have been then asked to sign on a letter regarding EPF in Feb, 2018 which i signed on Trust.
After Few days, they started to change my role and stop doing good work so again i raised the concern and they told me that they will call me on demand basis and pay me accordingly which i denied and served my resignation with notice period of 30 days.
Firm has only paid me my long pending incentive and Gratuity as full and final payment but my last month salary was hold by the firm.
I want to file complaint for the voilation of following matters:
1- Non Benefit under EPF act
2. Non payment of earned Leave encashment.
3- Non payment of Annual Bonus.
4- Non payment of Salary.
